NearEcho Terms of Use

These terms govern use of the NearEcho application for Android and iOS (the “App”), provided by Aybilge OÜ (“we”). By using the App you accept these terms. If you obtained the App from Apple’s App Store or Google Play, that store’s terms also apply; for the App Store, Apple’s standard Licensed Application End User License Agreement applies in addition to these terms.

1. The service

NearEcho lets phones near each other exchange messages without internet or mobile network, over Bluetooth and local Wi-Fi. Each phone running the App can pass messages on, so messages can reach people further away. The App also includes SOS calls with location, an “I’m safe” status and an offline survival guide.

How far and how fast messages travel depends on the number of phones nearby, distance, obstacles, device models, operating system settings and battery. Delivery of any message, including SOS calls, is not guaranteed. There are no servers: messages exist only on the phones that send, relay and receive them.

2. Not an emergency service

NearEcho is not an emergency service and does not replace calling emergency services. An SOS call reaches only people nearby who run the App, and nobody may receive it or be able to help. Whenever you can, call the official emergency number (112 works on most mobile phones, even without a SIM card) and follow instructions from authorities and rescue teams.

3. Survival guide

The survival guide offers general information that we compiled and simplified from public-domain government publications and widely accepted first-aid guidelines. It is not medical, legal or professional advice and does not replace first-aid training, a doctor or instructions from authorities. Situations differ; use your judgement and get professional help as soon as possible. Translations are provided for convenience; the English text is the reference version. We review the content carefully but cannot guarantee that it is complete, current or suitable for every situation.

4. Price and optional purchases

The App is free to download and use, with no advertising and no subscription. Every feature is available without payment. We may offer optional in-app purchases that let you support the App’s development; such purchases are voluntary, are not donations to a charity, and do not unlock any feature needed to communicate or to ask for help (at most they may add cosmetic extras, such as themes or app icons). Purchases are made through Apple’s App Store or Google Play; price, taxes, payment and refunds are governed by the store’s terms and applicable consumer law.

5. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on devices you own or control. You may share unmodified copies of the App with other people free of charge, for example with the App’s “Share the app” feature. Ownership and intellectual property rights in the App remain with Aybilge OÜ and other relevant rights holders. Except as expressly allowed by applicable law, you may not modify, resell or distribute modified versions of the App. The App includes third-party components that are licensed under their own terms, listed in the App’s About screen.

6. Your use of the App

You are responsible for the messages you send. You must not use the App to:

• send false SOS calls or false emergency information, which can put lives at risk;
• harass, threaten or impersonate others, or send unlawful, abusive or misleading content;
• send spam or flood the network in a way that prevents others from communicating;
• break the law or the rights of others, or interfere with the App’s security.

Public channels are visible to everyone nearby. Because the App has no servers, we cannot read, moderate or remove messages; use the block feature and contact local authorities if you are threatened. Verify the people you talk to with “Verify with QR” before you share sensitive information.

7. Updates and availability

We may update the App for security, compatibility and functionality, and updates may change features. Phones running different versions may not support every feature together. We do not promise that the App will work without interruption or on every device. Bluetooth, Wi-Fi, background operation and battery behaviour depend on your device and operating system. If these terms change materially, we will publish the updated text with its effective date.

8. Liability

The App is provided free of charge, as a communication aid for situations without regular networks. To the extent permitted by law, we are not liable for losses caused by messages that are not delivered or arrive late, by the actions of other users, by third-party services, by incompatible devices, or by reliance on the survival guide. Nothing in these terms limits liability for intent or gross negligence, for death or personal injury where such limitation is not allowed, or removes consumer protections and mandatory legal guarantees that cannot lawfully be excluded.

9. Governing law

These terms are governed by the laws of Estonia. If you are a consumer, you keep the protection of the mandatory laws of your country of residence. You may contact us first about any dispute; your statutory complaint and legal remedies remain available.
